The terms for release following an arrest on or after October 1, 2007, without charges, are laid out in Section 10-103.1 of the Criminal Procedure Code. The statute states that within 60 days of being released, the individual has the right to have their record erased. Nevertheless, it may take three years after the date of expungement for the record to be removed entirely.

In Maryland, a prosecutor or the state may formally notify of their intention not to pursue a criminal case. If the defendant is unaware of the charges against them, the Calvert County District Court may inform them of their desire to drop them. According to Maryland Code, Criminal Procedure, Section 10-104, the District Court may order the erasure of any relevant court records, arrest records held by the police, and any other state-filed records about the charges or the arrest.

The Maryland Code also provides that after being arrested and charged with a crime carrying a jail sentence, an individual may be able to petition the state to delete all arrest records. This is only possible if they meet specific requirements. These requirements include:

  • Probation is imposed on the petitioner before judgment (PBJ).
